Introduction
The AML & Regulatory Compliance Senior Manager will provide specialist assistance to Bank Gaborone Line Management by ensuring adherence to all applicable anti-money laundering laws and regulations as well as to all core / relevant regulations. This position involves overseeing the development, implementation, and maintenance of the compliance programs, policies and procedures as well as providing guidance and support to various business units, to mitigate compliance risk ( AML and Regulatory ).
The incumbent will actively participate in process re-engineering, product development and other project meetings where invited, to provide subject matter expertise on both AML and Regulatory Compliance.
The incumbent will also have to Stay up to date with changes in all core regulations, AML laws and regulations and ensure the company's compliance program evolves accordingly.
Job description
1. POLICIES, MANUALS AND FRAMEWORKS
- Develop and maintain standard templates for Compliance policies, policy guidelines, terms of reference and other governance-related documents
- Control of governance documents (such as policies, guidelines, and terms of reference).
- Drive the governance framework across the bank
2. AML AND COMPLIANCE PROGRAM MANAGEMENT
- Design, implement, and manage Bank Gaborone's AML compliance program to ensure adherence to all relevant laws and regulations;
- Identify and analyze the bank’s compliance risk universe in accordance with the bank wide-approved methodology;
- Establish and continuously improve a consistent operating framework for the identification, management, monitoring and reporting of AML/CFT/CPF risks and issues.
- Workshopping relevant business units to categorize and assess the applicable regulatory requirements in order to prioritize the risks in terms of the risk matrix;
- Apply Generally Accepted Compliance Practice as developed by the Compliance Institute of Southern Africa when monitoring and advising on the regulatory universe and embedding the compliance process;
- Develop and document compliance risk management plans in accordance with Generally Accepted Compliance Practice and the bank compliance framework;
- Facilitate the implementation of controls documented in risk management plans and communicate the compliance risk management plans to affected parties;
- Facilitate and/ effect the periodic review and update of risk management plans and establish whether there are any updates to the regulatory requirements that should be addressed in the risk management plan;
- Perform/conduct periodic risk assessments on all products and services to identify potential AML and regulatory risks and develop strategies to mitigate these risks.
- Work closely with other departments, including Legal, Risk Management, and Internal Audit, to ensure a cohesive approach to compliance.
- Define the local requirements, scope and deliverables for projects or SBCs before the PI in which the project is to be prioritized and manage the execution of all AML compliance projects.
4. COMPLIANCE MONITORING
- Develop relevant compliance tools for the allocated regulatory requirements to assist management to manage the associated compliance risk;
- Oversee the monitoring of transactions for suspicious activity and ensure timely reporting of suspicious transactions to the relevant authorities with the specified timeframes;
- Lead and manage investigations into suspicious activities and ensure appropriate actions are taken.
- Develop and implement a compliance risk monitoring plan for the bank;
- Obtain input from compliance stakeholders in preparation for the development of a compliance monitoring plan before presenting it to management and governance stakeholders for approval;
- Scan the regulatory environment for proposed legislative/regulatory changes and creating awareness of such changes;
- Communicate and monitor emerging local/best practice governance requirements in terms of laws, regulations, and industry standards e.g., King IV Code of Corporate Governance, ISO standards.
- Reviewing and ensuring compliance with legislation affecting the Bank.
- Manage correspondent banking relationships.
5. COMPLIANCE REPORTING
- Draft reports for the relevant governance committees such as Bank Gaborone Executive Management Committee, Risk Committee and the Board Risk and Compliance Committee.
- Ensure timely and accurate reporting to regulatory authorities as required by legislation
- Determine the compliance reporting requirements to stakeholders and regulators / supervisors in terms of regulatory and/or bank`s requirements;
- Implement and maintain compliance reporting processes and submit compliance reports and other assignments to relevant stakeholders within requisite deadlines;
- Attend to queries and regulatory reports as required by the Financial Intelligence Agency
6. INDUSTRY REGULATOR, SUPERVISOR AND STAKEHOLDER INTERACTIONS
- Act as the primary point of contact for regulatory bodies and ensure the company is prepared for and responsive to regulatory examinations and audits.
- Provide commercially sound compliance guidance and support in respect of allocated regulatory requirements.
- Continued pro-active stakeholder engagement and involvement on a business, regulator and industry level.
- Assist management in reviewing and implementing the bank`s Contact with Regulators Policy and other procedures to address the management of the relationship with regulators and supervisors;
- Monitors and identifies difficulties and challenges in the relationship with regulators or supervisors and facilitates the development of remedial actions;
- Participate in regulator and supervisor working groups, meetings, and platforms;
- Consistently demonstrate the ability to appropriately implement regulatory requirements.
6. TRAINING AND AWARENESS
- Develop and deliver AML training programs as well as regulatory compliance, to employees to ensure they understand their responsibilities and the importance of compliance in the bank.
- Implement communication strategy and facilitate the implementation across Bank Gaborone
- Ensure that all employees are aware of the compliance measures, including policies, procedures, control mechanisms and the channel of reporting.
- Promote a compliance culture throughout Bank Gaborone
Minimum requirements
• Bachelor’s degree in finance, Law, Business Administration, or a related field
• Certified Regulatory Compliance Manager (CRCM) or equivalent certification will be an added advantage
• Certified Regulatory Compliance Manager (CRCM) or equivalent certification will be an added advantage
• Min of 7 years relevant experience in similar environment with at least 3 years in a managerial role.
